Joel S Feldman, Sidley Austin LLP

Joel S Feldman is the practice area co-leader for Sidley Austin LLP’s Insurance Disputes Practice Team, a group of over 35 litigators nationwide, and also heads Sidley’s Insurance Class Action Defense practice. Mr. Feldman has served as lead defence counsel in over 100 class actions venued in over 35 federal and state courts throughout the United States. These class actions have covered a wide variety of financial services and consumer subjects, including ERISA benefit plans, annuities, property and casualty insurance, health benefits and health coverage, service warranties, life insurance, and California 17200 claims.

Mr. Feldman has won a series of precedent setting class action defence victories. These include winning the only complete class certification denial and summary judgment victory among the many ERISA revenue sharing class actions, and the only complete class certification denial and only complete summary judgment victory amid the myriad of senior citizen annuity class actions. Mr. Feldman has also successfully tried a securities fraud class action to a jury verdict, named by the National Law Journal as one of the top ten trials of the year.

Mr. Feldman is a frequent lecturer and author on class actions. His most recent article, “Comcast’s Lasting Impact: Crystallization and Affirmation of the Rule 23(b)(3) Predominance Requirement,” 15 BNA Class Action Reporter 574 (May 23, 2014), won a 2015 Burton Award for excellence in legal writing.

Mr. Feldman is a 1974 graduate of Oberlin College and a 1979 graduate of the Georgetown University Law Center, where he served as Case and Note Editor for the Georgetown Law Journal.

Joshua E Anderson, Sidley Austin LLP

Joshua E Anderson has extensive experience handling the defense of class actions, appeals and complex, multi-party litigation in federal and state trial and appellate courts. Josh has substantial experience in the areas of insurance, life sciences, pharmaceuticals and consumer fraud. His recent victories include:

  • Obtaining voluntary dismissal with no payment required of nationwide class action claims against a life insurance company involving alleged “churning.”
  • Obtaining voluntary dismissal of statewide class action claims against a life insurance company involving alleged miscalculation of interest payments.
  • Obtaining a $104 million judgment for a pharmaceutical company in a Hatch-Waxman patent infringement lawsuit following a three-week bench trial, more than $98 million of which was affirmed on appeal by the Federal Circuit.
  • Obtaining dismissal, summary judgment and denial of class certification in a series of putative nationwide and statewide class actions against a pharmaceutical company involving the alleged false advertising of a prescription drug.
  • Obtaining voluntary dismissal with no payment required of nationwide class action claims against a pharmaceutical company involving challenges to its co-pay assistance programs for privately insured consumers.
  • Obtaining $118 million judgment for a Korean automobile manufacturer after a four-day bench trial before a bankruptcy court, which was affirmed on appeal by the district court and Ninth Circuit.

In 2017, Josh was named one of the BTI Client Service All-Stars, an elite group of lawyers whom world-leading corporate counsel recognize as client service leaders. He was also named a Super Lawyers Rising Star in 2006, 2007, 2009 and 2010 by Los Angeles Magazine.
